- “Agreement” includes these Terms and Conditions, the accepted quotation, proposal, statement of work, invoice, project agreement, Privacy Policy, and authorised written project communications.
By accessing plixweb.com, submitting an enquiry, accepting a quotation or proposal, making a payment, providing project materials, or authorising us to begin work, you confirm that you have read, understood, and agreed to these Terms and Conditions.
1. Services
Plixweb Solution provides IT and software development services, including:
- Website design and development
- Mobile application development
- Custom software development
- SaaS platform development
- E-commerce development
- UI and UX design
- API development and integration
- Payment gateway integration
- Third-party platform integration
- Cloud and server configuration
- Software maintenance
- Technical support
- IT consulting
- Other related technology services
The exact scope, features, deliverables, price, payment schedule, timeline, revisions, and support terms for each project will be stated in the applicable quotation, proposal, statement of work, or project agreement.
2. Eligibility and Authority
You must be legally capable of entering into a binding agreement to purchase our services.
When accepting these Terms on behalf of a company, organisation, partnership, or another entity, you confirm that you have the authority to represent and bind that entity.
You are responsible for ensuring that all information provided to us is accurate, complete, lawful, and authorised.
3. Enquiries and Quotations
Submitting an enquiry through our website, email, telephone, or another communication channel does not automatically create a service agreement.
A quotation or proposal may specify:
- Project requirements
- Included features
- Project deliverables
- Development stages
- Estimated timeline
- Payment schedule
- Revision limits
- Support period
- Third-party expenses
- Project-specific conditions
A quotation may be revised or withdrawn before it is accepted.
Unless otherwise stated, a quotation covers only the services and deliverables expressly mentioned in it.
4. Project Acceptance
A project may be considered accepted when the client:
- Signs a service agreement;
- Approves a quotation or proposal in writing;
- Confirms approval through email or an authorised recorded communication channel;
- Makes an advance or milestone payment;
- Provides instructions to begin work; or
- Provides project materials after accepting the commercial terms.
Once the project is accepted and work begins, the payment, cancellation, and refund conditions stated in these Terms and our Privacy Policy will apply.
5. Project Scope
Plixweb Solution will perform the work included in the accepted project scope.
The client must carefully review and approve the project scope before work begins.
Unless expressly included in the quotation or agreement, the following may be treated as additional services:
- Additional website pages or application screens
- New features or modules
- Additional user roles
- New APIs or integrations
- Additional payment gateways
- Major design changes
- New languages
- Data entry or content creation
- Search engine optimisation
- Digital marketing
- Domain, hosting, or cloud services
- Paid software or licences
- App Store or Play Store charges
- Ongoing maintenance and support
6. Changes and Additional Work
A request that changes or expands the approved project scope will be treated as a change request.
Change requests may affect:
- Project price
- Delivery schedule
- Development resources
- Technical architecture
- Testing requirements
- Third-party expenses
We may issue a revised quotation or additional invoice before beginning work outside the agreed scope.
Plixweb Solution is not required to begin additional work until the client approves the revised terms and makes any required payment.
7. Client Responsibilities
The client is responsible for providing all items reasonably required to complete the project, including:
- Clear project requirements
- Business and product information
- Text and other content
- Images, videos, logos, and brand assets
- Domain, hosting, or server access
- API and third-party account credentials
- Payment gateway information
- App Store or Play Store accounts
- Testing feedback
- Timely approvals
- Required legal policies, licences, and permissions
The client must ensure that all materials provided to Plixweb Solution are accurate, lawful, and do not infringe another person’s rights.
The client must not provide passwords, OTPs, banking PINs, or other unnecessary sensitive credentials through unsecured communication channels.
8. Project Communication
The client must provide valid contact information and identify the person authorised to approve the project.
Project requirements, feedback, approvals, and change requests should be provided through recorded communication channels such as:
- Authorised WhatsApp communication
- Project management software
- Written meeting records
- Other mutually agreed channels
Instructions received from an authorised client contact may be relied upon as valid project instructions.
The client is responsible for reviewing project communications and responding within a reasonable period.
9. Project Timeline
Any timeline provided by Plixweb Solution is based on:
- The approved project scope
- Timely payment
- Timely delivery of content and credentials
- Timely feedback and approval
- Availability of required third-party services
- No material change in requirements
The project timeline may be extended due to:
- Delayed feedback or approval
- Missing content or credentials
- Repeated changes in requirements
- Additional work
- Delayed payment
- Third-party service delays
- Technical complications
- Events outside our reasonable control
Unless expressly guaranteed in a signed agreement, a timeline is a reasonable estimate and not an unconditional guarantee of delivery on a fixed date.
10. Delayed or Inactive Projects
Plixweb Solution may place a project on hold when the client fails to provide required:
- Payment
- Content
- Credentials
- Information
- Feedback
- Testing
- Approval
Where a client remains unresponsive for an extended period:
- The original timeline may no longer apply.
- Assigned resources may be moved to other projects.
- The project may be treated as inactive.
- Restart or resource reallocation charges may apply.
- Work will resume according to resource availability.
- Third-party renewal or service expenses may remain payable.
A client delay will not be treated as a delay caused by Plixweb Solution.
11. Payments
The client must make payments according to the accepted quotation, proposal, invoice, or project agreement.
Payments may include:
- Advance payments
- Milestone payments
- Final delivery payments
- Recurring service fees
- Maintenance charges
- Third-party expenses
Unless otherwise agreed, work will begin only after receipt of the required advance payment.
Plixweb Solution may withhold final deployment, source code, project files, credentials, or ownership transfer until all applicable invoices are paid.
12. Taxes and Third-Party Charges
Unless expressly stated otherwise, quoted prices may exclude:
- Applicable taxes
- Bank charges
- Payment gateway charges
- Currency-conversion charges
- International transfer charges
- Third-party service expenses
- Software and licence costs
The client is responsible for applicable taxes and authorised third-party expenses connected with the project.
13. Late or Unpaid Payments
If a payment is not received by the applicable due date, Plixweb Solution may:
- Pause project work
- Delay delivery or deployment
- Suspend support or maintenance
- Restrict access to incomplete deliverables
- Revise the project schedule
- Suspend services managed by us
- Terminate the project after reasonable notice
Any resulting delay will not be considered a failure by Plixweb Solution to perform the service.
Completed-work charges and authorised expenses will remain payable.
14. Third-Party Services
A project may use third-party products or services, including:
- Domain registrars
- Hosting and cloud providers
- Payment gateways
- SMS and email providers
- WhatsApp services
- Map services
- Artificial intelligence APIs
- Social media platforms
- Plugins, themes, and libraries
- App Store and Play Store services
Third-party services are governed by their own terms, prices, policies, technical restrictions, and availability.
Plixweb Solution does not control or guarantee:
- Approval by a third-party platform
- Continuous availability of a third-party service
- Future pricing
- API availability
- Policy changes
- Account suspension decisions
- Security or performance of third-party systems
The client is responsible for maintaining required third-party accounts, subscriptions, licences, and renewals.
15. Domain, Hosting and Server Services
Where domain, hosting, cloud, or server services are arranged for the client:
- The service may be provided by an independent third party.
- Renewal charges are payable by the client.
- Renewal prices may change.
- The client must ensure timely renewal.
- Service availability remains subject to the provider’s terms.
Plixweb Solution will not be responsible for loss or interruption caused by expiry, suspension, or non-renewal of a domain, server, hosting plan, licence, or third-party subscription.
16. Mobile Application Publication
Where mobile application publication is included, the client must provide active and compliant developer accounts.
Application publication remains subject to the rules and approval process of the relevant application store.
Plixweb Solution does not guarantee:
- Application approval
- Approval within a particular time
- Continued application listing
- Acceptance of every feature
- Prevention of developer-account suspension
- Approval of future application updates
Any work required because of major policy changes or new platform requirements may be separately charged unless included in the project scope.
17. Testing and Approval
Plixweb Solution will conduct reasonable testing according to the agreed project scope.
The client is also responsible for reviewing and testing:
- Designs
- Content
- Forms
- Features
- User roles
- Calculations
- Payment processes
- Integrations
- Mobile responsiveness
- Application behaviour
- Final deliverables
The client must report identified issues within the applicable review or support period.
A milestone or deliverable may be considered approved when the client:
- Provides written approval;
- Authorises deployment;
- Makes the next milestone payment;
- Starts using the deliverable; or
- Does not report a material issue within the agreed review period.
18. Revisions
The number and nature of included revisions will be stated in the applicable quotation or proposal.
A revision means a reasonable modification to work already completed within the approved project scope.
A revision does not include:
- A completely new design
- A new feature or module
- A major workflow change
- A change in business model
- Rebuilding previously approved work
- Replacing the approved technical architecture
- Substantial changes to approved content
Additional revisions and out-of-scope work may be separately charged.
19. Delivery and Deployment
Delivery may take place through:
- Deployment on the client’s server
- Deployment on a server managed by us
- Transfer of source code or project files
- Application build files
- Repository access
- Another agreed delivery method
Delivery and ownership transfer are subject to receipt of all outstanding payments.
After final delivery, the client is responsible for maintaining appropriate backups unless a separate backup or maintenance service has been purchased.
20. Support and Maintenance
Post-delivery support will be provided only for the period and scope stated in the accepted quotation or agreement.
Included support may cover verified defects in features included in the approved project scope.
Support does not automatically include:
- New features
- Design changes
- Content updates
- New integrations
- Server migration
- Third-party platform changes
- Problems caused by client modifications
- Problems caused by unauthorised persons
- Problems caused by third-party software
- Ongoing security monitoring
- Continuous maintenance
Ongoing support and maintenance may require a separate paid agreement.
21. Intellectual Property Rights
21.1 Client Materials
The client retains ownership of original materials supplied by the client, including:
- Logos
- Trademarks
- Text
- Images
- Videos
- Business data
- Product information
The client grants Plixweb Solution permission to use those materials only as reasonably necessary to perform the project.
21.2 Custom Deliverables
Ownership of custom deliverables will transfer to the client only:
- After full payment of all applicable invoices; and
- To the extent stated in the accepted quotation or agreement.
Until full payment is received, unpaid designs, code, files, and deliverables remain the property of Plixweb Solution or the applicable rights holder.
21.3 Pre-Existing and Reusable Materials
Plixweb Solution retains ownership of its pre-existing and reusable:
- Code libraries
- Frameworks
- Templates
- Tools
- Generic modules
- Processes
- Systems
- Technical knowledge
The client receives the rights reasonably necessary to use the completed project but does not obtain exclusive ownership of our general reusable materials unless expressly agreed.
21.4 Third-Party Materials
Third-party software, plugins, themes, fonts, images, libraries, APIs, and licences remain subject to their respective licence conditions.
22. Client Content and Lawful Use
The client is responsible for the legality and accuracy of its business, content, services, and instructions.
The client must not request or provide material that:
- Infringes copyright, trademark, or other rights
- Violates privacy or data-protection rights
- Is fraudulent, misleading, or unlawful
- Contains malware or harmful code
- Violates third-party platform rules
- Is defamatory or prohibited by law
Plixweb Solution may refuse, suspend, or terminate work involving unlawful, fraudulent, infringing, or harmful activities.
23. Confidentiality
Each party will use reasonable measures to protect non-public business, technical, financial, and project information received from the other party.
Confidential information may be used only for the relevant project or service.
These obligations do not apply to information that:
- Is publicly available without breach of confidentiality
- Was already lawfully known
- Is lawfully received from another source
- Is independently developed
- Must be disclosed under applicable law or legal order
A separate non-disclosure agreement may be signed where required.
24. Portfolio Use
Unless otherwise agreed in writing, Plixweb Solution may display publicly launched project information in its portfolio, including:
- Client or project name
- Public logo
- Screenshots
- Public website or application link
- General description of the services provided
We will not intentionally publish private credentials, confidential source code, or non-public client data.
A client requiring complete portfolio confidentiality must request it in writing.
25. Privacy
The collection, use, retention, and protection of personal information are governed by the Privacy Policy published on plixweb.com.
The client is responsible for ensuring that any website, application, software, or SaaS platform developed for the client contains appropriate:
- Privacy notices
- Cookie notices
- Consent mechanisms
- Terms and Conditions
- Refund terms
- Other legally required policies
26. Project Cancellation and Refund
Cancellation and refund requests will be handled according to the refund section contained in the Privacy Policy published on plixweb.com, together with any project-specific agreement.
26.1 Cancellation Before Work Starts
Where the project is cancelled before any work begins, the payment received may be eligible for a refund.
Any non-recoverable third-party or project-related expense already incurred may be deducted.
26.2 Cancellation After Work Starts
Where cancellation is requested after work begins:
- The completed work will be assessed.
- The value of completed work will be deducted.
- Third-party and other non-refundable expenses will be deducted.
- The remaining eligible balance, if any, will be refunded.
If the completed-work value and incurred expenses are equal to or greater than the payment received, no refund will be payable.
26.3 Completed or Delivered Projects
A refund will normally not be available after:
- Final project completion
- Final client approval
- Deployment
- Transfer of source code or files
- Substantial completion
- Use of the completed product or service
26.4 Refund Processing
An approved refund will normally be initiated within 7 to 10 business days.
The bank, UPI provider, card issuer, or payment gateway may require additional time to credit the amount.
27. No Guarantee of Commercial Results
Unless expressly stated in a signed agreement, Plixweb Solution does not guarantee:
- Website traffic
- Search engine rankings
- Sales or revenue
- Application downloads
- User registrations
- Business growth
- Advertising results
- Investment or funding
- Approval by an application store
- Approval by a payment gateway, bank, or government authority
- Continuous operation of third-party services
Our responsibility is limited to providing the technical services and deliverables included in the agreed project scope.
28. Warranty and Technical Limitations
Plixweb Solution will use reasonable skill and care while providing the agreed services.
However:
- Internet-based services may experience interruption.
- Third-party systems may change without notice.
- Software cannot be guaranteed to be free from every possible defect.
- No security system can prevent every possible cyber incident.
- Future compatibility with every device, browser, operating system, or third-party platform is not guaranteed.
- Problems caused by unauthorised modifications are not our responsibility.
Any specific warranty will be limited to the terms stated in the accepted quotation or agreement.
29. Limitation of Liability
To the extent permitted by applicable law, Plixweb Solution will not be liable for indirect, incidental, special, or consequential loss arising from:
- Loss of profit or revenue
- Loss of business opportunity
- Loss of goodwill
- Loss caused by third-party services
- Loss caused by unauthorised modifications
- Failure by the client to maintain backups
- Incorrect information provided by the client
- Suspended or expired third-party accounts
- Events outside our reasonable control
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded.
Any applicable liability will be determined according to the relevant project agreement and applicable law.
30. Client Responsibility for Claims
To the extent permitted by applicable law, the client will be responsible for claims, losses, or expenses resulting from:
- Unlawful client content
- Infringing materials provided by the client
- Misuse of the completed project
- Unauthorised or illegal business activities
- Violation of third-party terms
- Incorrect client instructions
- Modifications made by the client or unauthorised persons
This provision will not apply to the extent a claim is directly caused by the proven unlawful conduct of Plixweb Solution.
31. Suspension and Termination
Plixweb Solution may suspend or terminate a project where:
- Required payments are not made
- The client materially breaches the agreement
- The client requests unlawful work
- The client provides fraudulent or infringing content
- Continuing the project creates a security or legal risk
- The client repeatedly fails to provide required cooperation
- A required third-party service becomes unavailable
Where reasonably possible, we will provide notice and an opportunity to resolve the issue.
Completed-work charges and non-refundable expenses will remain payable.
32. Force Majeure
Plixweb Solution will not be responsible for delay or failure caused by events outside its reasonable control, including:
- Natural disasters
- Fire or flood
- War or civil disturbance
- Government action
- Power or internet failure
- Cyberattacks
- Public emergencies
- Labour disruption
- Cloud or server outages
- Third-party platform failure
- Changes in law or platform policy
Project timelines may be reasonably extended during such events.
33. Complaints and Dispute Resolution
Clients should first contact Plixweb Solution regarding any complaint or dispute.
A complaint should include:
- Client name
- Project name
- Relevant invoice or transaction reference
- Description of the issue
- Supporting information
- Requested resolution
We will make reasonable efforts to review and resolve genuine complaints through direct communication.
Nothing in these Terms limits any right that cannot lawfully be excluded.
34. Governing Law and Jurisdiction
These Terms and Conditions will be governed by the applicable laws of India.
Subject to applicable law and any jurisdiction that cannot legally be excluded, disputes will be subject to the jurisdiction of the competent courts in Rajasthan, India.
35. Changes to These Terms
Plixweb Solution may update these Terms when:
- Our services change
- New features are introduced
- Our payment or delivery processes change
- Our business practices change
- Applicable legal requirements change
The revised Terms will be published on this page with an updated “Last Updated” date.
Changes will not unfairly alter project-specific terms already accepted for an ongoing project without appropriate notice or agreement.
36. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
The affected provision will be limited or interpreted only to the extent necessary to make it valid and enforceable.
37. No Waiver
A failure or delay by Plixweb Solution in enforcing any provision will not constitute a waiver of that provision or right.
Any waiver must be expressly provided in writing.
38. Entire Agreement
These Terms and Conditions, together with the accepted quotation, proposal, invoice, statement of work, Privacy Policy, and project-specific agreement, constitute the agreement between Plixweb Solution and the client.
Where a signed or expressly accepted project-specific agreement directly conflicts with these general Terms, the project-specific agreement will take priority, subject to applicable law.

40. Acceptance of Terms
By accessing plixweb.com, submitting an enquiry, accepting a quotation or proposal, making a payment, providing project materials, or authorising Plixweb Solution to begin work, you confirm that you have read, understood, and agreed to these Terms and Conditions.
